These Terms of Service ("Terms") govern your access to and use of SewFlow's website and services at sewflow.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

SewFlow converts images, text, and AI-generated artwork into machine embroidery files (such as JEF, DST, PES, EXP, XXX, and SEW) and provides related tools including a design studio, a community design library, and a customer account portal. We may add, change, or remove features at any time.

Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and be at least 13 years old to use the Service. Notify us promptly of any unauthorized use of your account.

Acceptable Use

You agree not to:

Upload or create content that infringes others' intellectual property, privacy, or other rights.
Upload unlawful, harmful, or offensive content, or content you do not have the right to use.
Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service.
Resell or redistribute the Service itself, or abuse free allowances or credits.

Your Content and Intellectual Property

You retain ownership of the images and text you upload and the embroidery files you generate from them. You are responsible for ensuring you have the rights to any content you upload. You grant us a limited license to process and store your content solely to operate the Service for you (for example, to generate files and save designs to your account).

The Service itself — including our software, design, and branding — is owned by SewFlow and protected by intellectual property laws. These Terms do not transfer any of those rights to you.

AI-Generated Content

When you use AI features, artwork is generated using third-party AI providers based on the prompts you supply. AI output may be imperfect or similar to results others receive, and you are responsible for reviewing it and ensuring your use is lawful and non-infringing.

Embroidery File Disclaimer

Embroidery results depend on your machine, hoop, stabilizer, thread, fabric, and settings. We provide digitized files on an "as is" basis and do not guarantee that any file will stitch perfectly on every machine or material. Always test-stitch on a sample before production, and adjust settings as needed.

Subscriptions, Billing, and Cancellation

Some features require a paid subscription billed through Stripe on a recurring basis until cancelled. By subscribing, you authorize us to charge your payment method for each billing period. You can cancel at any time and will retain access until the end of the current paid period. For details on refunds and cancellations, see our Refund Policy.

Third-Party Services

The Service relies on third parties such as Stripe (payments), Resend (email), and OpenAI (AI generation). Your use of those features may also be subject to those providers' terms. We are not responsible for third-party services.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, SewFlow will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or materials, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify and hold SewFlow harmless from claims, damages, and expenses arising out of your content or your violation of these Terms.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service.

Changes to the Service and Terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by applicable law in the jurisdiction in which SewFlow operates, without regard to conflict-of-law principles.
